PARTICIPATION BY PUBLIC IN MEETING

 

Please review the Agenda to determine if the subject you wish to discuss is scheduled for Council consideration.  If it is on the Agenda, you will have an opportunity when that matter comes up for discussion to briefly address the Council.

 

If the subject is not on tonight’s Agenda, please complete an Agenda Request Form (on Clerk’s table) and present it to the City Council Clerk.  You will have the opportunity to speak on the subject under Item 5.2. However, if the item is not on the Agenda, each speaker will be limited to one five (5) minute opportunity to speak, unless the City Council makes an exception due to special circumstances.

 

The Brown Act prohibits the Council from taking action on any item not placed on the printed Agenda in most cases. 

 

Effective July 1, 2008, the Brown Act requires any non-confidential documents or writings distributed to a majority of the City Council less than 72 hours before a regular meeting will be made available to members of the public at the same time they are distributed.

 

City Council meetings are televised and can be seen live on Cable Public Access Channel 11 and on tape delay the following morning at 10:00 a.m.

 

In compliance with the Americans with Disabilities Act, the City of Anderson will make available to members of the public any special assistance necessary to participate in this meeting.  The public should contact the City Clerk’s office (378-6646) to make such a request.  Notification 72 hours prior to the meeting will enable the City to make reasonable arrangements to ensure accessibility to this meeting.

4.0       PRESENTATION – Christine Haggard and Barbara Jackson will introduce the Anderson Middle School Safe Routes to School elective class, who will make a presentation on the flag project.

5.4       COUNCIL REPORTS - City Councilmembers will report on attendance at conferences/meetings reimbursed at City expense (Requirement of Assembly Bill 1234).

 

6.0       CONSENT AGENDA - Consent Agenda items are expected to be routine and non-controversial.  They will be acted upon by the Council at one time without discussion.  Any member of the public, staff or City Council may request that an item be removed from the Consent Agenda for separate discussion.  Are there any requests to remove any items from the Consent Agenda?

 

6.1        MINUTES - Approve the minutes of the regular meeting of June 7, 2011.

    

6.2       WARRANTS – Receive and file warrant 119797 to 119863 in the amount of $248,422.34; warrant 119864 to 119928 in the amount of $193,452.65; an ACH in the amount of $1,862.40; and a          Wire Transfer in the amount of $371.16.

 

6.3       CITY ATTORNEY – None.

 

6.4       CITY CLERK – Waive reading, except by title, of any ordinances under consideration at this meeting for either introduction or passage per Government Code Section 36934.

 

6.5       CITY MANAGER – None.

 

6.6       FINANCE DIRECTOR/TREASURER – None.

6.8       DEVELOPMENT SERVICES DEPARTMENT – Enact Ordinance No. 772 (second reading), rezoning 7.66 acres from Medium Density Residential (R-2) to Single Family Residential (R-1), as introduced on June 7, 2011 (first reading).

7.0       PUBLIC HEARING REGARDING ESTABLISHING LIMITATIONS ON SMOKING IN_PUBLIC PLACES

 

            RECOMMENDED ACTION:

 

      1.   Conduct a public hearing.

 

      2. Subject to testimony received, introduce an ordinance (first reading) amending Anderson Municipal Code Section 9.38.250 and set July 5, 2011 for enactment (second reading).

 

      3.   Adopt a resolution limiting smoking in public places.

 

The City Council will recess and the Anderson Redevelopment Agency will convene.

PUBLIC HEARING:  ADOPTION OF BUDGET AND CAPITAL IMPROVEMENT PLAN (This is a large document)

 

RECOMMENDED ACTIONS:

 

            The City Manager recommends, at the conclusion of the public hearing, that the City Council:

 

1.     Adopt a resolution adopting budget appropriations for fiscal year 2011-2012.

 

2.     Adopt a resolution establishing the Gann appropriation limit for fiscal year 2011-2012 and finding that the adopted appropriations are within the limit.

 

3.     Adopt a resolution approving an update of the Five-Year Capital Improvement Plan.

 

The Executive Director recommends, at the conclusion of the public hearing, that the Anderson Redevelopment Agency:

 

1.        Adopt an Anderson Redevelopment Agency resolution adopting budget appropriations for the Southwest Project Area for fiscal year 2011-2012.

 

2.        Adopt an Anderson Redevelopment Agency resolution adopting budget appropriations for the SHASTEC Project Area for fiscal year 2011-2012.

 

The Executive Director recommends, at the conclusion of the Public Hearing, that the Anderson Public Financing Authority:

 

1.        Adopt an Anderson Public Financing Authority resolution readopting a zero budget for the Anderson Public Financing Authority for fiscal year 2011-2012.

 

 

 

The Anderson Public Financing Authority and the Anderson Redevelopment Agency will adjourn, and the City Council will continue.

8.8a     PROFESSIONAL SERVICES AGREEMENT FOR THE DEVELOPMENT OF PLANS, SPECIFICATIONS AND ESTIMATES FOR THE DESCHUTES ROAD/I-5 INTERCHANGE IMPROVEMENT PROJECT

 

            RECOMMENDED ACTION:

 

            Adopt a resolution directing the City Manager to approve a professional services   agreement with Omni-Means, Ltd., for the development of plans, specifications  and estimates for the Deschutes Road/I-5 interchange improvement project.

 

8.8b     NOTICE OF COMPLETION OF THE CITY OF ANDERSON PHASE 2 AUTOMATIC  METER READ (AMR) METER REPLACEMENT PROJECT

           

RECOMMENDED ACTION:

 

            Direct the Public Works Director to prepare and record a Notice of Completion for the City of Anderson Phase 2 Automatic Meter Read (AMR) Meter Replacement  Project and authorize the Finance Director to make payment for the project in compliance with the contract documents.

 

8.8c     ADOPTION OF A LOCAL DISADVANTAGED BUSINESS ENTERPRISE (DBE) POLICY FOR CONTRACTS UTILIZING STATE AND FEDERAL TRANSPORTATION FUNDS

           

RECOMMENDED ACTION:

 

Adopt a Resolution establishing a Disadvantaged Business Enterprise (DBE) Policy Goal as defined in Part 26, Title 49 Code of Regulations for agencies that desire to use State and Federal-aid Transportation Funds; establishing an overall Annual Goal for the utilization of DBE's at 8.3% with 4.0% Race Neutral and 4.3% Race Conscious for the Federal Fiscal Year October 1, 2011 to September 30, 2012; and designating the Engineering Services Manager as DBE Liaison Officer to develop and carry out the technical assistance programs for DBE's.

 

9.0              STAFF REPORTS – City Manager Dana Shigley will give an oral staff report on the Knighton Road development update.

 

10.0     ADJOURN - The City Council will adjourn to June 30, 2011.
